Act 03-1

CONTRABAND PUNISHMENTS

 

SECTION I

 

            Part I, sub-part A, section 2, #12 in the Code for Student Behavior will be added to read:

 

"Contraband shall be defined as anything that the GPGC administration or student government decides students should not be allowed to bring to the program from an outside source."

 

SECTION II

 

            Part I, sub-part E, section 18, #6 in the Code for Student Behavior will be added to read:

 

"Contraband offenses."

 

SECTION III

 

            Part I, sub-part E, section 24, in the Code for Student Behavior will be added to read:

 

    Students convicted of having contraband money will have the amount that they were convicted of having taken out of their account. Students convicted of having other contraband items will receive a fine decided upon by their counselor and will have the item confiscated to be held by the student's counselor until the next time that that child returns home, at which time the item will be returned to the student's parent/guardian.

 

SECTION IV

 

            If any portion, provision, or application of this Act is held to be invalid, the remaining provisions of this act which may be given effect without the invalid portion, provision, or application are to be given the fullest possible effect. To that end, the provisions of this Act are severable.

 

SECTION V

 

            All laws or parts of laws in conflict herewith are repealed.

 

 

 

Act 03-2

 

TICKET COURT

 

SECTION I

 

            A committee consisting of two student justices and one counselor, the members of which shall change every session, shall be established. The student justices shall rotate every session, while the Coordinator of Housing will choose the counselor. This committee shall hereafter be referred to as Ticket Court.

 

SECTION II

 

           This Ticket Court will meet every Monday and Wednesday at 6:00 PM. At this time all tickets will be brought before the Ticket Court. All staff members who have issued tickets since the previous session of ticket court are required to attend. Any students who have been issued tickets are required to attend according to the rules set forth in Act 01-01.

 

 

SECTION III

 

            At each session, the names of the students who were given tickets that week shall be posted. From this list, each name will be called. When their name is called, that student may choose to contest the ticket that was issued to them. If so, the student and the staff member who issued the ticket will then appear before the court. If the staff member who issued the ticket is the counselor on duty at Ticket Court for the session, another counselor shall replace him for the duration of the contestation of his tickets. If the student who has received the ticket is one of the two student justices sitting on the Ticket Court for that session, the third justice shall replace him for the duration of the contestation of his tickets. If the third justice is not present, a counselor will be appointed to sit. The staff member will describe the circumstances in which the ticket in question was issued, and the student will give his defense. After this, the Ticket Court shall decide whether or not the ticket will hold as it was originally given. It may be decided that the fine be reduced or voided entirely. All decisions shall be approved by a majority vote of both the student justices and the counselor. If a student wishes to appeal the decision made by the Ticket Court any further, they may bring it before the Student Court.

 

SECTION IV

 

          

            Should any portion, provision, or application of this Act is held to be invalid, the remaining portions, provisions and applications of provision, shall remain intact and be upheld by dormitory staff. To this end, the provisions of this Act are severable.

 

 

SECTION V

 

            All laws or parts of laws in conflict herewith are repealed.

 

 

Act 04-2

DEFACEMENT OF BRAIN BUCKS (TOKENS)

 

SECTION I

 

            No person may scratch, break, erase, mark, mar, or deface any Brain Buck (token) to the point where it becomes unusable by the Governor's Program for Gifted Children.

 

 

SECTION II

 

            Any person found to have committed such an act will be fined $.25 for their first offense, $1.00 for their second offense, and $5.00 for their third offense. Any further offenses will be handled as the administration deems correct.

 

 

SECTION III

 

            Should any portion, provision, or application of this Act is held to be invalid, the remaining portions, provisions and applications of provision, shall remain intact and be upheld by dormitory staff. To this end, the provisions of this Act are severable.

 

 

SECTION IV

 

            All laws or parts of laws in conflict herewith are repealed.

 

 

ACT 04-3

APPROPRIATIONS BILL

 

SECTION I

 

           The following funds shall be drawn from the treasury and added to the following persons' accounts:

            $1.00 for the Activities Committee Members.

 

SECTION III

 

            Should any portion, provision, or application of this act be found invalid, the remaining portions, provisions, and applications shall remain intact and be upheld. To this end, the provisions of this act are severable.

 

SECTION IV

 

            All laws or parts of laws in conflict herewith are repealed.

 

Act 04-4

CONTEMPT OF TICKET COURT

 

SECTION I

 

            Contempt of Ticket Court is (1) willful disobedience of any Order, Judgment, or Decree of the GPGC Ticket Court of which the person in question has received notice; (2) disorderly conduct in the presence of the GPGC Ticket Court while court is in session after being admonished by the presiding Justice of Ticket Court to cease such conduct or to leave the courtroom; (3) any act that would impede the Justices' ability to rule with fairness and justice.

 

SECTION II

 

            A majority of sitting Justices shall be required to find someone in Contempt of Ticket Court. Once a person is placed in Contempt by the Justices he or she will be subject to the punishments outlined in Section Four. A finding of Contempt may be appealed only to the Appellate Court of the GPGC and must be appealed within one school day.

 

SECTION III

 

            Any counselor or staff member may write a ticket for the infraction of Contempt of Ticket Court. The Justices may, at their discretion, consider such a ticket during the court session that it refers to, or delay consideration until the next session of Ticket Court.

 

SECTION IV

 

            Contempt of Ticket Court shall be punished in the following manner:

 

                    (1) A first offense shall be punished by a $1.00 fine.

 

                    (2) A second offense shall be punished by a $2.00 fine.

 

                    (2) A third offense shall be punished by a $5.00 fine in addition to being referred to the Director for possible suspension or expulsion from the Governor's Program.

 

SECTION V

Act 04-5

ILLEGAL SALES AND PURCHASE OF GOODS AND SERVICES 

 

SECTION I

 

            The regular selling of any good or service without a license shall be prohibited.

           

SECTION II

 

            The regular selling of any good or service is defined, for the purposes of this Act, as one or more of the following:

 

            1. The selling of any foodstuffs or prepared food bought with the express purpose of selling such items for profit.

 

            2. The selling of any item for $3.00 or more.

 

            3. A consistent selling of any item or service over an extended period of time.

 

SECTION III

 

            The selling, at any time, of any foodstuffs or prepared food that was not bought by a student of the GPGC is expressly forbidden. This will be considered to be regular selling without a license even if the seller holds a valid GPGC corporation license.

 

 

SECTION IV

 

            Any student or staff member may charge a student or staff member with selling a good or service without a license. The procedure for this is as follows:

 

            1, A student or staff member must provide the Secretary with a written affidavit charging a student or staff member with selling a good or service without a license. The affidavit should contain as much pertinent information as possible including a description of the good or service sold, the amount of the transaction, as well as any evidence that the selling is regular (as defined above).

 

            2. The Secretary shall, within one school day of receiving the affidavit, convey it to the Chief Justice of the Student Court.

 

            3. The Chief Justice shall, within two school days of receiving the affidavit, call a special session of the Student Court to consider the charge as specified.

 

            4. The Court shall have the power to call any witnesses to testify as to the validity of the charge.

 

            5. The defendant shall have the right to defend himself or herself, or to contract with another student, staff member, or professional lawyer, to defend himself or herself in front of this special session of the Court. The defendant, or his or her representative, has the right to call witnesses on his or her behalf, as well as to cross-examine any witnesses brought against him or her.

 

            6. After hearing all relevant testimony, the Court will decide on the guilt or innocence of the defendant regarding the charge of regular selling without a license.

 

            7. If the defendant is found guilty, he or she will be subject to the penalties outlined in Section V.

 

 

SECTION V

 

            The penalty for regular selling without a license shall be no less than $20.00. The Justices may increase this penalty as they see fit but the penalty must not be greater than the total estimated profit gained by the illegal selling.

 

 

SECTION VI

 

            The defendant may appeal the finding of the Student Court, including the penalty, to the GPGC Appellate Court. The decision must be appealed within one school day.

 

 

SECTION VII
