DEFINITIONS OF REGULAR AND SPECIAL APPOINTMENTS

 

SECTION I

 

            Regular appointments shall be defined as Chief Justice, Court Recorder, and all other appointments specifically stated in the Constitution.

 

SECTION II

            Special appointments shall be defined as all appointments that are not appointed offices, but elected offices, which, under certain circumstances must be filled.

RANDOM CHOOSING OF JURY FOR AN IMPEACHMENT TRIAL

 

SECTION I

           

            The jury for an impeachment trial shall be chosen by the Chief Justice of the Student Court, unless he is the accused official, in which case the President shall appoint one of the Associate Justices of the Student court to select the jury. In either case, the jury shall be selected from an alphabetic list of all the full-time students enrolled in the Governor’s Program for Gifted Children. He shall begin with the fifth name, not counting names of persons who have already served on a jury during that school session, and designate each tenth person, as possible members of the jury until twenty (20) students are chosen.

 

SECTION II

 

            The justice selecting the twenty students shall, after hearing the advice of the Office of the Defense and the Office of the Prosecution, appoint six people from the twenty to form an impartial impeachment jury.

CONTEMPT OF COURT

 

SECTION I

 

            Contempt of Court shall be defined as willful disrespect to the court and its purposes in such a way that it impedes the ability of the Court to minister justice. Contempt of Court shall not include disorderly conduct.

 

SECTION II

 

            The penalty for contempt of court shall be an official reprimand by the Court for the first offense, and expulsion from the program for the second offense of the same nature in the same school session.

SETTLING TIES IN A RUN OFF ELECTION

 

SECTION I

 

            When a tie in a run-off election occurs, not including the Legislative elections, the Legislature will vote to choose the candidate.

 

SECTION II

 

            When a Legislative run-off is held and a tie occurs, a re-vote will be taken. A maximum of two more run-offs will be held.  After these run-offs, and if no candidate is the winner, the Legislature shall decide which candidate(s) shall take office.

 

SECTION III

 

            Inauguration of governmental officials shall not be held until all members are elected.

SPECIAL ELECTIONS

 

            The Election Officer shall have the power to call special elections if required by circumstance.

ATTORNEYS IN IMPEACHMENT CASES

 

            In the case where a member of the Legislature is selected to act as an attorney in an impeachment hearing and trial, he shall not be allowed to cast a vote in the decision of that case.
