Act 78-1

 

DEFINITION OF THIRD, SECOND AND FIRST YEAR STANDING

 

SECTION I

 

            A student of third year standing shall be defined as a full-time student in his third year of having attending the Governor’s Program for Gifted Children, be they consecutive or otherwise.

 

SECTION II

 

            A student of second year standing shall be defined as a full-time student in his second year of having attended the Governor’s Program for Gifted Children, be they consecutive or otherwise.

 

SECTION III

 

            A student of first year standing shall be defined as a full-time student in his first year of having attended the Governor’s Program for Gifted Children.

 

Act 78-2

LEGALIZATION OF THE LEGISLATIVE MANUAL

 

SECTION I

 

            The legal authority for all legislative procedures shall be vested in the Legislative Manual.

 

SECTION II

 

            The process for amending the Legislative Manual shall be the same as that for enacting statutes.

FORM FOR A PETITION FOR NOMINATION FOR GOVERNMENT

 

SECTION I

 

            The form for a petition shall be as follows:  In the upper left-hand corner the words, “Governor’s Program for Gifted Children” shall appear. Immediately below shall be the date the petition is due. Beneath this, the words, “We, the undersigned, endorse (Name of Person) as a candidate for the office of (Name of Office).” Shall appear.

 

SECTION II

 

            Only petitions on the official form and with signatures in ink shall be accepted as valid.

TERMS FOR THE JUSTICES OF THE COURT OF APPEALS

 

            The terms of the Office of Justice of the Court of Appeals shall be determined at the discretion of the Director of the Governor’s Program for Gifted Children.

 

 

 

Act 78-8

FILING OF RESIGNATIONS

 

SECTION I

 

            All officials resigning from the Government of the Governor’s Program for Gifted Children shall submit the following form to the Director of the Governor’s Program for Gifted Children:

                       

                        I, (Name of Official), (Name of Office), of the Government of the

                        Governor’s Program for Gifted Children resign for the following reason(s):

 

                                                (List of Reasons)

 

SECTION II

 

            This resignation shall go into effect immediately upon reception of the resignation by the Director of the Governor’s Program for Gifted Children.

 

SECTION III

 

            There shall be a re-election for the office three school days after the resignation is submitted. The replacing official shall be installed on the day the election or on the following day if a run-off takes place.

 

Act 78-9

NUMBER OF SIGNATURES REQUIRED FOR NOMINATION PETITIONS

 

            If the percentage of the affected student body which is needed to sign a petition is a mixed number, the fraction shall be rounded off to the next highest whole number, unless the resulting number shall be less than two, in which case the minimum number of students required to sign the petition shall be two and this shall define the minimum number of persons who must sign the petition for the petition to be valid.

 

Act 78-10

INSTALLATION OF GOVERNMENT OFFICIALS

 

SECTION I

 

            Installation of government officials shall be held the school day following the last run-off election. In the case that there are no run-off elections, the installation shall be held the school day following the regular election provided that the election results were checked separately by the Election Officer and a member of the faculty or staff appointed by the Director of the Governor’s Program for Gifted Children. The first meeting of the new legislature shall be held the same day as the installation.

 

SECTION II

 

            The oath of office shall be administered to the newly elected President of the Government of the Governor’s Program for Gifted Children by the Director of the Program. The President shall then administer the oath to all other officials of the Government.

 

 

 

SECTION III

 

            The officials shall be sworn in according to the following order: President, Vice President, Secretary, Legislative Branch (as a group), Justices of the Student Court (as a group), Office of the Defense (as a group), and the Office of the Prosecution (as a group).

 

SECTION IV

 

            The oath of office shall be as follows: I do solemnly swear that I will faithfully execute the office of ____________ of the Government of the Governor’s Program for Gifted Children and will, to the best of my ability, preserve, protect, and defend its constitution

Act 78-13

FORM FOR PETITION TO AMEND THE CONSTITUTION

 

            The form for a petition to amend the Constitution shall be as follows:

 

                        We, the undersigned, support an amendment to the Constitution as follows:

Act 78-14

 

PROCEDURE FOR FILING A CHARGE

 

SECTION I

 

            The complainant must file with the Office of the Prosecution a written complaint or petition having his signature or required signatures, the date of the filing, the charge, and the reason for the charge.

 

SECTION II

 

            The office of the Prosecution must conduct an investigation into the complaint to determine whether or not there are sufficient grounds for a trial.

 

 

 

 

 

SECTION III

 

            If the Office of the Prosecution finds that there are sufficient grounds to justify a trial and as soon as the legal form of the charge has been validated, then it will file the charge with the Court Recorder by the end of the first school day after the complaint has been filed with the Office of the Prosecution.

 

SECTION IV

 

            The Court Recorder shall submit the charge to the Chief Justice of the Student Court, who, after conferring with the Office of the Prosecution, and the Office of the Defense, will set a date for the trial.

 

SECTION V

 

            The charges shall be posted in conspicuous places by the Court Recorder and a copy of the charge shall be delivered by the Court Recorder to the defendant and to the Office of the Defense as soon as it is filed.

 

SECTION VI

 

            The verdict and the sentence will be filed by the Court Recorder and posted the conspicuous places.

 

SECTION VII

 

            The above procedure shall apply to all members of the Governor’s Program for Gifted Children, including all students, faculty and staff.

Act 78-22

REMOVAL OF OFFICIALS FOR TRIAL AND IMPEACHMENT

 

SECTION I

 

            When a government official has been formally charged with a violation of the law, he shall be suspended from office until such time as a verdict is rendered.

 

SECTION II

 

            The highest ranking governmental official not charged shall appoint a qualified student to temporarily replace the official that has been charged, except in the case where an executive is charged, in which case the constitutionally established procedure of executive succession shall be followed.

 

SECTION III

 

            If the official is convicted, the Director of the Governor’s Program for Gifted Children shall call for a new election in that specific office.
