In order to enable students of the Governor’s Program for Gifted Children to have more time to socialize with members of the opposite sex, and utilize lobby resources, lobby curfew is hereby set at 8:55 P.M. Sunday through Thursday
Act 98-2
SECTION I
A Sergeant-at-Arms shall be appointed by the President, prior to the first public meeting of the House of Representatives. He or she must be a student or faculty member in good standing of the Governor’s Program for Gifted Children. He shall serve for one year and until a new Sergeant-at-Arms is appointed.
SECTION II
The duties of the Sergeant-at-Arms shall be to make sure the public is attending the public meetings with respect, and to expel the public as ordered by the President. He or she shall also maintain order at public meetings of the House of Representatives.
Act 98-3
REPEAL OF SUPERCEDED AND OUTDATED ACTS
SECTION I
The following Acts of the GPGC Legislature are hereby repealed in their entirety: 71-1, 73-1, 73-3, 73-5, 78-7, 80-1, and 86-1.
SECTION II
If any portion, provision, or application of this Act is held to be invalid, the remaining provisions of this act which may be given effect without the invalid portion, provision, or application are to be given the fullest possible effect. To that end, the provisions of this Act are severable.
SECTION III
All laws or parts of laws in conflict herewith are hereby repealed.
Act 98-4
An Act to define the offenses of Contempt of Court and Aggravated Contempt of Court, to provide for the penalties therefore, and to authorize the Student Government Advisor in conjunction with GPGC Legal Counsel to codify the provisions of this Act as an appropriately numbered Section of the Code of Student Behavior.
Be it enacted by the Legislature of the Governor’s Program for Gifted Children
SECTION I
Act 68-14 is hereby repealed in its entirety.
SECTION II
Contempt of Court is (l) willful disobedience of any Order, Judgement, or Decree of any GPGC Court of which the defendant has received notice; (2) disorderly conduct in the presence of a GPGC court while court is in session after having been admonished by the presiding Justice of that court to cease such conduct or to leave the courtroom.
SECTION III
Aggravated Contempt of Court is any further act of Contempt by the same offender in the same session of the GPGC, irrespective of whether the acts of Contempt were committed in the same or in different matters or occurred close together in time.
SECTION IV
Contempt of Court is a Serious Offense. Aggravated contempt of Court is a Very Serious Offense.
SECTION V
If any portion, provision, or application of this Act is held to be invalid, the remaining provisions of this act which may be given effect without the invalid portion, provision, or application are to be given the fullest possible effect. To that end, the provisions of this Act are severable.
Act 98-5
TAXATION AUTHORITY AND APPROPRIATIONS
SECTION I
The present Income Tax levied on students salaries for the benefit of the Government is hereby continued in force and legislatively ratified for the remainder of the 1998 session and until the Legislature shall repeal or modify the tax as provided herein.
SECTION II
Any legislation imposing or altering the rate of any tax on GPGC students shall originate in the House of Representatives. Legislation respecting the procedure for calculation, collection, or enforcement of such a tax, or providing for other ancillary matters pertaining to taxation, may originate in either the House of Representatives or the Senate.
SECTION III
No Government monies shall be expended except pursuant to a Government Budget and Appropriation Acts, as provided for herein.
SECTION IV
With the assistance of the Student Government Advisor or other Faculty or Staff Member assigned to this function by the Director, the President shall each year prepare and present to the Legislature a Budget for the Government. The Budget shall consist of an estimate of Government revenues derived from existing taxes and from other sources, if any, and anticipated government expenditures. If anticipated expenditures are in excess of anticipated revenues, the Budget shall contain a description of the additional tax(es) or other source(es) of revenue necessary to ensure that anticipated revenues equal or exceed anticipated expenditures.
SECTION V
The Budget shall be presented to the Legislature as a Joint Resolution, and shall be enacted by both the House and the Senate as provided by law. For the 1998 session, the Budget shall be presented to the Legislature no later than the fifth school day following the effective date of this Act. In succeeding sessions, the President shall complete the Budget no later than the fifth school day after he is elected and installed and shall present it to the Legislature on the following school day.
SECTION VI
The Legislature shall implement the Budget by appropriate legislation. New taxes or modifications of the existing tax shall be imposed by Act of the Legislature, originating in the House. Appropriations shall be by Act of the Legislature, originating in either the House of Representatives of the Senate, and may be made singly, or may be grouped together in one or more General Appropriation Acts.
SECTION VII
If any Act of the Legislature shall impose or modify more than one tax, or shall include more than one appropriation, the Presidential veto power shall extend to each such individual item such that the President may veto one or more taxation or appropriation items while approving others. To that extent, the President shall enjoy what is commonly known as a “line item veto”. This veto shall be subject to the limitations and procedures provided for by law.
SECTION VIII
If any tax is to be collected by GPGC Faculty or Staff, the Student Government Advisor shall issue appropriate written instructions for doing so to the relevant faculty or staff member(s). If any tax is to be collected by GPGC Students, the Legislature shall provide for such collection by appropriate legislation.
SECTION IX
If any portion, provision, or application of this Act is held to be invalid, the remaining provisions of this act which may be given effect without the invalid portion, provision, or application are to be given the fullest possible effect. To that end, the provisions of this Act are severable.
SECTION X
All laws or parts of laws in conflict herewith are hereby repealed.
Act 98-6
MINIMUM GPA FOR OPERATION OF BUSINESS
SECTION I
No student may receive a license to operate a business at the GPGC unless that student shall have an overall GPGC grade point average of at least 2.75 and an average of no lower than 2.0 in any one class or item. The official responsible for granting licenses shall submit the names of all applicants for licenses to the Student Government Advisor who shall certify to the presenting official whether the applicant possesses the requisite grade point average as of the date of the application.
SECTION II
The Student Government Advisor shall maintain a list of all students holding licenses and shall verify as of each grading period that each student possesses the required grade point average. If any student’s grade point average falls below that specified in the foregoing Section, the Student Government Advisor shall certify that fact in writing to the official responsible for granting licenses, who shall then inform the student that his license is probationary.
SECTION III
If a student’s grade point average is below that specified in Section I of this Act for any two grading periods, the Student Government Advisor shall certify that fact in writing to the official responsible for granting licenses who, upon written notice to the license holder, shall revoke the license for the remainder of the session.
SECTION IV
Operation of a business by a student whose license has been revoked pursuant to this Act is a Serious Offense, as that term is defined in the Code of Student Behavior. Beginning with the receipt of notice that the license has been revoked, any proceeds derived from the operation of a business by a student whose license has been revoked pursuant to this Act shall be subject to forfeiture and shall become property of the Government.
SECTION V

SECTION VI

Act 98-7
REDUCTION OF EXCESSIVE EXPOSURE TO INTELLECTUALLY DELETERIOUS MEDIA
SECTION I
GPGC students shall not be permitted to possess television sets in their dormitory rooms and while resident at the GPGC, may watch television only in the dormitory lobby. There shall be only one television set in the dormitory lobby. In the event that the University shall have placed more than one television set in the dormitory lobby and should GPGC dormitory staff be unable to remove such set(s), GPGC dormitory staff shall take appropriate steps to render the additional set(s) inoperable for the duration of the GPGC session.
SECTION II
The dormitory lobby television set shall be kept turned off at all times, except that the set shall be turned on only from 6:55 to 8:55 PM, Central Daylight Time, on weekdays. During the weekends, the television set may be turned on only when allowed by dormitory staff, acting within its sole discretion. The selection of program(s) to which the set is turned shall be within the sole discretion of the GPGC dormitory staff. The programs should be selected bearing in mind the educational purposes and moral goals of the GPGC.
SECTION III
If any dormitory in which GPGC students reside has more than one lobby or other common room suitable for television viewing, dormitory staff may at its sole discretion allow television viewing in that room or rooms in addition to the dormitory lobby. Television viewing in the additional room shall otherwise be subject to the limitations set forth in this Act.
SECTION IV
Dormitory staff may, in its sole discretion, allow television viewing in addition to that permitted by this Act. Nothing in this Act shall be construed to restrict dormitory staff from watching television outside of the presence of students or to prohibit possession of television sets in the dormitory by any GPGC faculty or staff member residing therein.
SECTION V
Violation by a student of the provision of this Act shall be a Serious Offense, as that term is defined in the Code of Student Behavior.
